Welcome to King Gallery Furniture. By purchasing from us, scheduling a consultation, visiting our showroom, using our website, or otherwise engaging with our services, you agree to the following Terms of Service.

1. General Overview

King Gallery Furniture ("King Gallery Furniture," "we," "our," or "us") provides appointment-only showroom consultations, furniture sales, delivery services, assembly services, financing options through third-party providers, and related products and services.

By purchasing products, scheduling appointments, using our website, or otherwise engaging with our services, you agree to be bound by these Terms of Service, our Privacy Policy, Return Policy, Shipping Policy, and any additional policies or disclosures provided at the time of purchase.

2. Sales Policy

All purchases are subject to King Gallery Furniture's Return Policy, Shipping Policy, Privacy Policy, and any additional disclosures provided at the time of purchase.

Returns, refunds, exchanges, cancellations, damaged merchandise claims, and warranty-related requests are governed exclusively by the terms and conditions outlined in the applicable policies.

Not all purchases, products, transactions, claims, or circumstances qualify for a return, refund, exchange, cancellation, store credit, repair, replacement, or other remedy. Eligibility requirements, reporting deadlines, fees, exclusions, limitations, and available remedies are outlined in the applicable policies.

Product Availability & Substitutions

Inventory availability may change without notice.

If a purchased item becomes unavailable, discontinued, backordered, delayed, or otherwise cannot be fulfilled as ordered, King Gallery Furniture reserves the right, at its sole discretion, to provide a substantially similar replacement item of comparable style, functionality, configuration, and value, offer an alternative product, issue store credit, or provide another remedy permitted under the applicable policies.

Minor differences in dimensions, color shades, fabric texture, stitching, hardware, cushions, orientation, accessories, design details, manufacturer specifications, or natural material characteristics shall not constitute a defect and shall not independently qualify an order for cancellation, return, refund, exchange, chargeback, or refusal of delivery.

By placing an order, the customer authorizes King Gallery Furniture to substitute a substantially similar product when reasonably necessary to fulfill the order.

Customer Inspection & Reporting

Customers are responsible for inspecting merchandise upon delivery or pickup.

Any damage, defects, shortages, missing components, or concerns must be reported within the timeframe specified in King Gallery Furniture's Return Policy.

Failure to report a claim within the applicable reporting period may result in denial of the claim and shall constitute acceptance of the merchandise in its delivered condition.

3. Delivery Policy

Delivery estimates, service areas, delivery procedures, unattended delivery authorization, risk of loss, delivery fees, delivery requirements, and reporting requirements are governed by King Gallery Furniture's Shipping Policy.

All delivery dates, lead times, arrival dates, and delivery windows are estimates only and are not guaranteed.

Customers are responsible for ensuring that delivery locations are safe, accessible, and capable of accommodating the purchased furniture.

Customers must verify that furniture will fit through doorways, hallways, elevators, stairwells, entryways, and into the intended room prior to purchase.

King Gallery Furniture shall not be responsible for furniture that cannot fit into a customer's residence, business, apartment, elevator, doorway, stairwell, or desired location.

Customers remain responsible for all applicable charges, fees, and obligations associated with their order regardless of fitment issues.

King Gallery Furniture shall not be liable for delays caused by weather, traffic, labor shortages, supply chain disruptions, carrier delays, manufacturer delays, acts of God, vehicle breakdowns, governmental actions, or circumstances beyond our reasonable control.

Additional delivery, storage, handling, redelivery, or related fees may apply as outlined in the Shipping Policy.

4. Consultations & Scheduling

Showroom visits are by appointment only.

Customers are expected to arrive on time for scheduled consultations.

If a customer is running late or needs to reschedule, they should contact us as soon as possible.

Failure to appear for a scheduled consultation without notice may result in forfeiture of the appointment time slot and may require rescheduling based on availability.

5. Product Representation

King Gallery Furniture makes reasonable efforts to provide accurate descriptions, photographs, dimensions, specifications, and product information.

Actual colors, finishes, textures, materials, comfort levels, dimensions, and appearance may vary due to manufacturing differences, lighting conditions, photography, screen settings, supplier modifications, and natural material characteristics.

Such variations shall not constitute defects and shall not independently qualify an order for cancellation, return, refund, exchange, chargeback, or refusal of delivery.

Customers are encouraged to inspect and test merchandise in person whenever possible before making a purchase decision.

6. Customer Responsibilities

Customers agree to:

  • Provide accurate contact and delivery information.

  • Review King Gallery Furniture's Return Policy, Shipping Policy, and Terms of Service before making a purchase.

  • Ensure furniture dimensions are appropriate for the intended space.

  • Verify that furniture will fit through all entryways and access points.

  • Inspect merchandise promptly upon delivery or pickup.

  • Follow all manufacturer care, maintenance, and safety instructions.

King Gallery Furniture shall not be responsible for damage resulting from improper use, abuse, neglect, unauthorized modifications, accidents, pets, children, environmental conditions, improper cleaning methods, normal wear and tear, or customer-caused damage.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KING GALLERY FURNITURE'S TOTAL LIABILITY ARISING FROM ANY PURCHASE, DELIVERY, PRODUCT, SERVICE, OR TRANSACTION SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE SPECIFIC ITEM GIVING RISE TO THE CLAIM.

KING GALLERY FURNITURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of use

  • Loss of profits

  • Emotional distress

  • Travel expenses

  • Installation expenses

  • Storage costs

  • Alternative furniture purchases

  • Lost opportunities

  • Property damage

  • Personal injury

  • Business interruption

Any remedy available to the customer shall be determined in accordance with King Gallery Furniture's Return Policy, Shipping Policy, applicable warranties, and applicable law.

8. Payment Disputes & Chargebacks

By completing a purchase, the customer agrees to first contact King Gallery Furniture and provide a reasonable opportunity to address and resolve any concerns before initiating a chargeback, payment reversal, or payment dispute.

Customers acknowledge that these Terms of Service, order confirmations, invoices, delivery records, delivery photographs, communications, delivery acknowledgments, GPS records, tracking information, financing records, and related documentation may be used as evidence in responding to payment disputes.

Fraudulent, abusive, or unauthorized chargebacks may result in collection efforts, legal action, recovery of attorney's fees and costs where permitted by law, and reporting to applicable payment processors.

9. Privacy & Communications

By scheduling a consultation, submitting information through our website, subscribing to communications, or making a purchase, customers consent to receive communications from King Gallery Furniture, including phone calls, text messages, emails, appointment reminders, delivery updates, promotional offers, and customer service communications.

King Gallery Furniture does not sell customer information to third parties.

10. Warranty Disclaimer

Manufacturer warranties, if any, apply solely according to the manufacturer's terms and conditions.

Except as required by law, King Gallery Furniture does not provide any additional warranties beyond those expressly provided by the manufacturer.

Nothing in these Terms shall limit any rights expressly provided under King Gallery Furniture's Return Policy, Shipping Policy, applicable law, or any applicable manufacturer warranty.

11. Financing Disclaimer

Financing arrangements offered through Acima, Synchrony, Shop Pay Installments, Progressive Leasing, Affirm, or other third-party financing providers are separate agreements between the customer and the financing provider.

Approval decisions, financing terms, payment schedules, fees, interest charges, and financing disputes are solely the responsibility of the financing provider and the customer.

King Gallery Furniture is not responsible for financing decisions or financing-related disputes.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas.

Any dispute arising from these Terms, a purchase, or any transaction with King Gallery Furniture shall be resolved exclusively in the state or federal courts located within Texas.

Customers consent to the jurisdiction and venue of such courts.

13. Modifications

King Gallery Furniture reserves the right to update, modify, amend, or replace these Terms of Service at any time.

Updated Terms become effective upon posting to our website and apply to future transactions.
